In accordance with the requirements of article 13, 14 and 21 of the General Data Protection Regulation (GDPR), we would like to inform you about the processing of the personal data you have transmitted as part of the application process and any personal data we may collect as well as your rights in this regard. Purposes and legal basis for processing your personal data

The legal basis enables us to collect your personal data in conformity with the European General Data Protection Regulation (EU-GDPR) and the German Bundesdatenschutzgesetz (BDSG) and to process it for internal purposes. The legal basis is Article 88 GDPR in conjunction with Section 26 BDSG-neu and, if applicable, Article 6 Paragraph 1 lit. b GDPR for the initiation or implementation of contractual relationship.

Furthermore, we can process your personal data if this is necessary to fulfill legal obligations (Article 6 Para. 1 lit. c GDPR) or to defend against legal claims made against us. The legal basis for this is Article 6 Paragraph 1 lit. F GDPR. The legitimate interest is, for example, a burden of proof in proceedings under the Allgemeines Gleichbehandlungsgesetz (AGG). If you give us your consent to the processing of personal data for certain purposes, the legality of this is based on your consent according to Article 6 Para. a GDPR. A given consent can be revoked at any time.

If there is an employment relationship between you and us, we can, according to Article 88 GDPR in conjunction with §26 BDSG-neu, process the personal data already received from you for the purpose of employment relationship, insofar as this is necessary for the implementation or termination of the employment relationship.

Which personal data do we process?

We only process data that is received from you by post or email when you contact us with your application.

This can be general data about yourself (name, address contact details, etc.), information about your professional qualifications and school education, information about professional training and, if applicable, other data that you transmit to us in connection with your application.

GoToMeeting

We may carry out video interviews using a third-party platform, namely the service “GoToMeeting” by LogMeIn Ireland Limited, Bloodstone Building Block C, 70 Sir John Rogerson’s Quay, Dublin 2, Ireland (https://www.logmeininc.com/de/legal/privacy). Any personal information you share in a video will be processed by the engaged third-party platform (GoToMeeting) for using their service and will be shared with Smart4Diagnostics GmbH for the purpose of and as part of the application process. If you do not want to share your data via video call with us, please let us know and we will arrange a meeting in person or a phone call instead.

You may also share details of other people with us; for example, if you were referred for the job (by an employee you know at Smart4Diagnostics GmbH or otherwise). In those circumstances, you will need permission from that person to share their personal information with us, and for us to use it in accordance with this Recruitment Privacy Policy.

Who will receive your data?

We only pass on your personal data within our company to those areas and persons who need this data to fulfill contractual and legal obligations or to implement our legitimate interests.

Otherwise, data will only be passed on to recipients outside the company insofar as legal provisions allow or require this, the passing on is necessary to fulfill legal obligations or we have your consent.

A transfer to a third country is not intended.

How long will your data be stored?

We store your personal data as long as is necessary to make a decision about the application.

Your personal data and/or application documents will be deleted after a maximum of 3 month following the end of application process (e.g. notification decision), unless longer storage is legally required or permitted.

In addition, we only save your personal data insofar as this is required by law or in a specific case to assert, exercise or defend legal claims for the duration of a legal dispute.

If, following the application process, an employment relationship, apprenticeship relationship or internship relationship occurs, your data will continue to be stored, if necessary and permitted, and then transferred to the personnel file.

Your rights in relation to data processing

Every affected person has the right to information under Article 15 GDPR, the right to rectification under Article 16 GDPR, the right to erasure under Article 17 GDPR, the right to restriction of processing under Article 18 GDPR, the right to notification according to Article 19 GDPR and the right to data portability according to Article 20 GDPR.

If the processing of data based on your consent, you are entitled under Article. 7 GDPR to revoke your consent to the use of your personal data at any time. Please note that the revocation will only take effect in the future. Processing that took place before the revocation is not affected. Please also note that we may have to keep certain data for a certain period to meet legal requirements.

You can assert all the above rights in accordance with Article 15 to 21 GDPR informally by email or post.

Do you have to provide us with the personal data?

The provision of personal data in the context of application processes is not required by law or by contract. You are therefore not obliged to provide information about your personal data. Please note, that these are necessary for the decision on an application or the conclusion of a contract in relation to an employment relationship with us. If you do not provide us with any personal data, we cannot make an informed decision to establish an employment relationship. We recommend that you only provide personal data in the context of your application that is necessary to carry out the application.

There is no automated decision-making process about your application (Art. 22 GDPR).We are happy to take time for your application documents. You’re worth it.
